Terms of Service

These Terms of Service ("Terms") govern your use of vppsolrite.com (the "Site"), operated by Solrite Electric, LLC ("Solrite," "we," "us," or "our"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

These Terms govern only your use of the Site. The Solrite Battery Virtual Power Agreement (the actual battery program) is governed by a separate written agreement that you'll sign after a welcome call with one of our specialists. Nothing on this Site constitutes the program agreement itself.

1. Eligibility

You must be at least 18 years old, a United States resident (or someone not exempt from federal U.S. income tax), and legally able to enter into a contract to use this Site. Currently, the Solrite Battery Virtual Power Agreement program is available only to homes located in Texas served by Oncor, CenterPoint Energy, AEP Texas, or TNMP. Submitting an application for a property outside these eligibility criteria does not entitle you to enrollment.

2. The Site Is Not the Program Agreement

Submitting the application form does not create a contract for the Solrite Battery Virtual Power Agreement program. After you submit an application, a Solrite specialist will call you to walk through the program in detail and, if you and Solrite both agree, you'll sign a separate written 20-year Battery Virtual Power Agreement that governs the actual battery system, the monthly payments, the warranty, the retail-electric-provider enrollment, and all other program terms. Your rights and obligations under that agreement are separate from these Terms.

3. Accuracy of Information

By submitting information through the Site you represent that all information is true, complete, and accurate. False or misleading information may disqualify you from the program and constitutes a default of the Battery Virtual Power Agreement if you become a customer.

4. Communications Consent

By submitting the application, you consent to receive phone calls and emails from Solrite, our installer partners, our retail-electric-provider partners, and our service providers regarding your application and the program. If you opt in to text messages on the application form, you also consent to receive SMS messages from us; standard message and data rates apply, and you may reply STOP at any time to opt out.

These communications may use automated dialing technology and pre-recorded messages, and may be delivered even if your phone number is on a state or federal Do Not Call registry. Consent to these communications is not a condition of any other service.

5. Soft Credit Inquiry

If you check the credit-consent box on the application, you authorize Solrite and our finance partners to obtain a soft consumer credit report. A soft inquiry has no impact on your credit score and is not visible to other lenders. If you proceed to install and program activation, our finance partner may run a separate hard inquiry — we'll notify you in writing before that happens.

6. Cancellation Window (After Signing the Battery Agreement)

If you sign the 20-year Battery Virtual Power Agreement, you have ten (10) business days from the date of signing to cancel under the cancellation form attached to your contract. This Site itself does not offer a separate cancellation right; the Battery Agreement does.

7. Intellectual Property

The Site and its content (text, graphics, logos, images, software) are owned by Solrite Electric, LLC or our licensors and are protected by U.S. copyright, trademark, and other intellectual-property laws. The "Duracell" name and logo are trademarks of Duracell U.S. Operations, Inc., used under license. You may not copy, reproduce, distribute, modify, or create derivative works from the Site without our written permission, except for personal, non-commercial use.

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. SOLRITE DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR HARMFUL COMPONENTS. SOLRITE IS NOT A UTILITY AND DOES NOT REPRESENT ANY UTILITY OR GOVERNMENT AGENCY.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SOLRITE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100).

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute arising out of or relating to your use of the Site will be resolved exclusively in the state or federal courts located in Tarrant County, Texas, and you consent to the personal jurisdiction of those courts. (Note: any dispute arising under the separate Battery Virtual Power Agreement is governed by the dispute-resolution and arbitration provisions of that agreement, not by this section.)

12. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects when we last revised them. Material changes will be communicated by email or through the Site. Your continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
